The specific services, features, deliverables, pricing and service period applicable to a client will be stated in the relevant quotation, invoice, proposal, package description or service agreement.

2. Quotations and Pricing

All prices displayed on our website are subject to change without prior notice.

A quotation or proposal provided by Epower is valid only for the period stated in that quotation. If no validity period is stated, Epower may revise the quotation at any time before payment or written acceptance.

Additional charges may apply where the client requests:

  • Additional pages or functions
  • Additional revisions
  • Custom programming
  • Third-party software or licences
  • Premium plugins, themes or services
  • Additional hosting resources
  • Additional content or design work
  • Additional advertising or marketing services
  • Work outside the original scope of the project

Any additional work will normally be quoted separately before the work is undertaken.

3. Payment

Unless otherwise agreed in writing, payment must be made according to the payment terms stated in the quotation or invoice.

For project-based services, Epower may require an upfront payment or deposit before work begins.

Work may commence only after the required payment has been received and cleared.

For recurring services such as hosting, maintenance, SEO, subscriptions or other ongoing services, payment must be made by the applicable renewal or billing date.

Epower reserves the right to suspend services where payment is overdue.

4. Website Development

For website design and development projects, the client is responsible for providing accurate information, content, images, logos, product information and other materials required for the project.

Project completion time depends on factors including:

  • Scope and complexity
  • Client response time
  • Availability of content and materials
  • Approval of designs
  • Third-party services
  • Payment gateway or other integration requirements
  • Technical issues outside Epower’s control

Any estimated completion date is an estimate and not a guaranteed delivery date unless expressly agreed in writing.

Delays caused by the client’s failure to provide information, approvals, access or payment may result in a corresponding extension of the project timeline.

5. Client Content and Materials

The client warrants that all content, images, videos, logos, trademarks, documents and other materials supplied to Epower may legally be used for the intended website or marketing purpose.

The client remains responsible for obtaining any necessary copyright, trademark, model-release, image or other permissions.

Epower is not responsible for claims arising from materials supplied by the client.

6. Revisions and Changes

The number of revisions included in a project will depend on the quotation or package purchased.

Requests that materially change the original project scope may be treated as additional work and may incur additional charges.

Examples include:

  • Changing the website structure after approval
  • Adding new pages
  • Adding new functionality
  • Changing the original design direction
  • Adding new integrations
  • Rebuilding completed sections

Epower may require written approval of additional charges before proceeding.

7. Website Hosting

Where Epower provides hosting services, hosting is provided subject to the applicable hosting package and resource limitations.

Epower will make reasonable efforts to maintain the availability, performance and security of the hosting environment.

However, Epower does not guarantee uninterrupted service or that a website will always be free from:

  • Downtime
  • Server interruptions
  • Cyberattacks
  • Malware
  • Hardware failure
  • Software failure
  • Internet outages
  • Third-party service interruptions
  • Events outside our reasonable control

Where appropriate, Epower may temporarily suspend hosting or related services for maintenance, security, technical reasons or non-payment.

8. Domain Names

Where Epower assists with domain registration or renewal, domain names remain subject to the rules and policies of the applicable domain registrar or registry.

Epower is not responsible for loss of a domain resulting from:

  • Failure to provide accurate registration information
  • Failure to provide renewal instructions
  • Non-payment of renewal fees
  • Registrar or registry policies
  • Suspension or cancellation by the relevant authority
  • Client actions or omissions

Clients are responsible for ensuring that their domain registration information remains accurate.

9. SEO Services

SEO services are intended to improve a website’s search visibility and organic traffic through appropriate optimization strategies.

However, Epower does not guarantee specific Google rankings, traffic levels, leads, sales or revenue.

Search engine algorithms, policies, competitors and other external factors can affect search results.

SEO results may take time and can vary depending on the website, industry, competition, content, technical condition and search engine changes.

10. Google Business Profile and Third-Party Platforms

Where Epower provides services involving Google, social media platforms, advertising platforms, hosting providers, payment gateways, plugins or other third-party services, those services remain subject to the relevant third party’s terms and policies.

Epower does not control third-party platforms and cannot guarantee:

  • Approval of an account
  • Continued availability of a third-party service
  • Search rankings
  • Advertising approval
  • Account suspension or reinstatement
  • Changes to third-party algorithms or policies

11. AI, Automation and Auto-Blog Services

Where Epower provides AI-generated content, AI chatbot, automation or auto-blog services, the client understands that artificial intelligence may occasionally produce inaccurate, incomplete or unsuitable information.

AI-generated content should be reviewed before being relied upon for important legal, financial, medical, technical or business decisions.

Epower does not guarantee that AI-generated content will be completely accurate, unique, error-free or suitable for every purpose.

The client remains responsible for reviewing and approving content published on their website.

12. Advertising and Marketing Services

Where Epower provides digital advertising or marketing services, advertising fees paid to platforms such as Meta, Google or other advertising networks are separate from Epower’s service fees unless expressly stated otherwise.

Epower does not guarantee a particular number of:

  • Leads
  • Enquiries
  • Sales
  • Customers
  • Clicks
  • Impressions
  • Advertising return on investment

Marketing performance can be affected by many factors outside Epower’s control, including market conditions, competition, pricing, offer quality, website conversion rates, customer behaviour and advertising platform policies.

13. Intellectual Property

Unless otherwise agreed in writing:

  • Epower retains ownership of its pre-existing systems, templates, frameworks, processes, tools, code libraries and proprietary materials.
  • The client retains ownership of content and materials supplied by the client.
  • Upon full payment, the client will receive the agreed rights to use the final deliverables specifically created for the client, subject to any third-party licences.
  • Third-party software, plugins, themes, fonts, images, stock materials and other licensed resources remain subject to their respective licence terms.

The client may not copy, resell, reproduce or distribute Epower’s proprietary systems, templates, frameworks or materials without written permission.

14. Third-Party Software and Services

Websites and digital systems may depend on third-party software, plugins, themes, APIs, hosting providers or other services.

Epower is not responsible for changes, discontinuation, incompatibility, price increases, security vulnerabilities or failures caused by third-party products or services.

Where a third-party licence or subscription is required, the applicable cost may be payable by the client.

15. Backups

Clients are responsible for maintaining copies of important business information and website content unless a specific backup service has been purchased from Epower.

Where backups are provided as part of a service, backups are intended as a recovery measure and should not be considered an absolute guarantee against data loss.

16. Website Security

Epower may provide security measures such as SSL, malware protection, security monitoring, updates or other security services depending on the package purchased.

No security system can guarantee complete protection against hacking, malware, data breaches or other cyber threats.

Clients are responsible for maintaining secure passwords and providing access only to authorized individuals.

17. Suspension or Termination

Epower may suspend or terminate a service where:

  • Payment is overdue
  • The client breaches these Terms
  • The service is being used for unlawful purposes
  • The website contains prohibited or harmful material
  • The service creates a security risk
  • The client engages in abusive or threatening behaviour
  • Continued service would violate applicable law or third-party policies

Where appropriate, Epower may provide notice before suspension or termination.

Termination does not automatically remove any outstanding payment obligations.

18. Refunds and Cancellation

Refund and cancellation terms will depend on the service purchased and the applicable quotation, invoice or service agreement.

Because certain services involve work, resources, licences or third-party costs that may be incurred immediately, payments may be non-refundable once work has commenced or third-party costs have been committed, except where otherwise required by applicable law.

Any refund request should be submitted to Epower in writing.

19. Acceptable Use

You agree not to use Epower’s services to create, host, publish, distribute or promote material that:

  • Violates applicable laws
  • Infringes intellectual property rights
  • Contains fraudulent or deceptive information
  • Facilitates illegal activities
  • Distributes malware or malicious software
  • Attempts unauthorized access to systems
  • Harasses or threatens others
  • Contains content that creates a significant security or legal risk

Epower reserves the right to investigate suspected violations and take appropriate action.

20. Limitation of Liability

Epower’s liability, where legally permitted, will be limited to the amount paid by the client for the specific service giving rise to the claim.
